SBP Ltd, trading as Europlas - Numerous complaints were received at both the ICO and the Telephone Preference Service. An ICO investigation found Europlas to be in breach of the Privacy & Electronic Communications Regulations. Clear Debt Solutions Ltd - A large number of complaints have been received from members of the public by both the ICO and the Fax Preference Service regarding the receipt of unsolicited direct marketing faxes having been sent from Clear Debt Solutions Ltd, in breach of Regulation 20 of the Privacy & Electronic Communications (EC Directive) Regulations 2003. Following an investigation into the matter, a Director of the company agreed to sign an undertaking to ensure the company's future compliance with the Regulations.

Satellite Direct UK Ltd and Satcover Ltd - Following an investigation by the ICO, Satellite Direct UK Ltd and Satcover Ltd, both of Hove, East Sussex, were found in breach of the Privacy and Electronic Communications Regulations after making unsolicited marketing calls using an automated calling system. As a result the Information Commissioner has required the two organisations to sign formal undertakings to stop making unsolicited marketing calls in breach of the Regulations.

Carphone Warehouse Group PLC - Carphone Warehouse Group PLC signed a legal undertaking in agreement with the ICO to stop making unsolicited direct marketing calls to individuals without their consent. This legally binding agreement follows a number of complaints about breaches of the regulations, which were made to us and the Telephone Preference Service (TPS).The agreement means that Carphone Warehouse cannot make calls for direct marketing purposes to people who are registered with the TPS or to individuals who have specifically told the company that they do not wish to receive direct marketing calls.
Following advice given by the Council on Tribunals, it is the Commissioner’s usual practice to serve a preliminary enforcement notice prior to serving an enforcement notice. This is not part of the statutory enforcement process; rather it is clear indication of the Commissioner’s intention to serve such a notice.
