Summary: The complainant asked the public authority for information about how much it had paid to an artist commissioned to make a video portrait of David Beckham, and who owned the work. The Gallery provided information about ownership but withheld other information, citing the exemptions contained in sections 21 and 43 of the Freedom of Information Act 2000. The complainant objected to the withholding of that part of the information to which the Gallery had applied section 43, and after the Commissioner’s intervention the Gallery released that information. The Commissioner has decided that section 43 did not apply at the time of the original request both because the prejudice to the commercial interests of the Gallery was insufficient to engage the exemption and that (even if the exemption had been engaged) the public interest in maintaining the exemption did not outweigh the public interest in disclosure. He has also decided that the Gallery breached section 17(3) of the Act because its refusal notice failed to explain its application of the public interest test. However, since the information has now been released the Commissioner does not require it to take any further action.

Summary: The complainant submitted a number of requests to the public authority during the period January 2005 to November 2005 about the public authority’s financial relationship with four local bus companies. In November 2005 the public authority refused to answer any further requests on this issue from the complainant. The Commissioner has decided that the public authority were correct to refuse to answer the complainant’s latest request on the basis that it was vexatious, although the public authority failed to provide a proper refusal notice citing section 14. The Commissioner has also decided that in responding to the complainant’s earlier requests the public authority breached section 10 several times by failing to respond to a number of requests within 20 working days. The Commissioner is satisfied that in responding to the requests the public authority provided all of the information covered by the requests, with the exception of one request.However, the Commissioner considers that the public authority could have also refused to answer this request on the basis that it was vexatious and therefore has not ordered the public authority to fulfil the outstanding parts of this request.

Summary: The complainant requested information relating to three land parcels from the public authority. The Commissioner has determined that the requested information constitutes environmental information. Therefore the requests should have been processed in accordance with the Environmental Information Regulations 2004 (‘the EIR’). The public authority did not consider the request under the EIR. It also initially refused to provide some of the requested information on the basis that it was personal data. When refusing access to the material the public authority did not issue a refusal notice which met with the requirements of Regulation 14. However following an internal review the public authority supplied the complainant with the information requested. The Commissioner is satisfied that the requested information has now been supplied to the complainant and therefore he has not specified any steps in this regard. The complainant did not consider the information supplied to him following the internal review was that which he had requested. Following the Commissioner’s intervention, the public authority identified the areas that were actually of interest to the complainant. It then supplied further material to the complainant. The Commissioner is satisfied that the public authority has complied with the complainant’s clarified request. In its initial refusal the public authority also explained that information on land parcel TA0436 9589 was not held. The Refusal Notice did not meet the requirements of Regulation 14. The complainant disputed the public authority’s assertion because he considered that it was under a legal obligation to map the land in question. The Commissioner has investigated the complainant’s assertion that further information is held regarding land parcel TA0436 9589. He is satisfied that the public authority does not hold any further information relevant to the request. He has not ordered any steps in relation to this part of the request. This decision is currently under appeal to the Information Tribunal.

Summary:
The complainant sought the names of those who had repaid money to the Council following excessive expenses claims, as well as details of the amounts each individual had repaid. The Council applied an exemption to the information under section 40 of the Act. During the investigation by the Commissioner, the Council also submitted that to disclose the information would exceed the appropriate limit (section 12) and, in any event, some information was already in the public domain and therefore exempt under section 21 of the Act. The Commissioner ascertained that the information could be split into two types, namely money repaid as a result of criminal convictions through compensation orders and voluntary repayments made by both convicted and nonconvicted Council members and officers. The Commissioner has decided that the cost of considering the request for all of the information would exceed the appropriate limit, but that the Council did not provide any advice and assistance with a view to the complainant narrowing his request (section 16). The Commissioner has therefore considered whether any of the information requested could be released and has decided that it would be fair to release names and details of repayments ordered to be made as a result of criminal convictions, but the names of those who made voluntary payments and the amounts involved is exempt under section 40. The Council should therefore release the information relating to the criminal repayments. The exemption under section 21 was not found to be valid.

Summary: The complainant requested copies of any emails sent by the policy officer to any of the planning officers at the council in respect of his client’s planning application. The council initially responded by stating that it did not hold any information falling within the scope of the request. Upon review the council then stated that the information was exempt under section 36 (effective conduct of public affairs), and section 22 (information intended for future publication) of the Freedom of Information Act 2000. When the complainant requested a further review of this decision the council responded stating that Regulation 12(4)(e) (internal communications) of the Environmental Information Regulations 2004 (‘the Regulations’) applied. During the course of the Commissioner's investigation the council wrote to the Commissioner and clarified that it had made a mistake in applying the exemptions and that it did not, in fact, hold any relevant information. After investigating this claim the Commissioner is satisfied that the council does not hold any information which falls within the scope of the request. The initial refusal letter to the complainant stated that no information was held, but it did not include all of the relevant information required by Regulation 14 of the Act. The Commissioner’s decision is therefore that the public authority did not comply with its obligations under Regulation 14.

This report was the result of an investigation into recruitments made in the Community Regeneration Department there. The Council responded that the information was not held. The complainant believed the notice would have been saved to the Council’s back up tapes. As the Council and the complainant could not agree upon which date they believed the notice had been posted, the Commissioner asked the Council to search a number of its back up tapes for the requested information. The Council then confirmed to the Commissioner that the contents of the back up tapes had been deleted. The Commissioner is satisfied that the information is no longer held by the Council; and that it is more likely than not that the information was not held at the time of the request.
